The undersigned Visitor has requested to be permitted access to certain areas of the Ramsey/Washington Recycling and Energy Center (hereinafter referred to as R&E Center). The undersigned Visitor agrees and represents that he/ she is aware that there are ongoing activities in the areas that Visitor may tour and agrees and represents that as such, Visitor will at all times adhere to all R&E Center safety guidelines (including wearing of Personal Protective Equipment), follow all directions given by R&E Tour Guide or R&E Employees, and follow all signage with regard to Safety. In consideration of being granted the right to access the various facility areas, the Undersigned/Visitor has agreed to execute this Waiver of Liability and Release and be bound by the terms hereof.

WHEREFORE, the Undersigned, for him/herself and for his/her personal representatives, heirs, next of kin, and assigns, acknowledges and agrees:

To the fullest extent permitted by law, the Undersigned (and on behalf of the Undersigned’s personal representatives, heirs, next of kin, and assigns) RELEASES, WAIVES AND DISCHARGES, AND COVENANTS NOT TO SUE, R&E Center, R&E Board, its elected officials, officers, agents, and employees (including duly authorized volunteers), any contractor or subcontractor, or any person engaged by R&E Center (collectively, the “Releasees”) for any cause(s) or claims arising out of or resulting from the Undersigned’s presence at R&E Center.

To the fullest extent permitted by law, the Undersigned will indemnify, defend, and save harmless R&E Center, R&E Board, its elected officials, officers, agents, and employees (including duly authorized volunteers), any contractor or subcontractor, or any person engaged by (collectively, the “Indemnitees”), from and against any and all allegations, claims, actions, suits, demands, damages, obligations, losses, settlements, judgments, costs, expenses (including, without limitation, attorney’s fees and costs), or liability (the “Losses”) for injuries to property, injuries to persons including death, and from any and all other claims, suits, or liability on account of or arising out of, in whole or in part, of any act or omission of the Undersigned, including negligence. The indemnification and hold harmless obligation hereunder shall not be limited by a limitation on amount or type of damages or compensation.

The Undersigned acknowledges that he/she has sole responsibility to evaluate carefully the risks in visiting area(s) of the R&E and he/she has fully considered those risks, including, without limitation, dangers posed by willful or negligent conduct of himself/herself and/or by others. The undersigned Visitor agrees that NO PERSON UNDER THE AGE OF 18 SHALL BE ALLOWED WITHIN THE R&E CENTER FACILITY except the areas known as the Mississippi/Tour Room and the areas immediately adjacent which must be accessed to gain entry to the Mississippi/Tour Room (also known as the Designated Tour Route). If at any time a Visitor under the age of 18 shall be granted an exception to access areas beyond the designated tour route, a parent or legal guardian must provide written permission on behalf of the minor.

The undersigned Visitor agrees to be governed by and follow all health, safety, or otherwise applicable rules and regulations of the R&E Center.

The undersigned Visitor agrees that at all times the undersigned Visitor will wear provided hard hats, vests, safety glasses. Ear protection may be offered but is not required.

The undersigned Visitor agrees and acknowledges that no person shall be allowed on the site unless accompanied by a duly authorized agent of R&E Center.

The undersigned Visitor agrees that if any portion of this document is held invalid, the remaining provisions shall be binding and continue in full force and effect.

I fully understand that by executing this document I am waiving, releasing and giving up potential legal rights. By executing this document, I intend to fully and finally waive all claims I may have against R&E Center and hereby release R&E Center from any liability arising from my presence on site, whether for negligence or otherwise. I have read this Waiver of Liability and Release carefully, understand its significance, and voluntarily agree to all of its terms.

Photo Release
I hereby grant permission to have my photo taken during the tour and understand that the photograph may be used in promotional advertising or other communication methods by the R&E Center.
